ABS regulations and the Nagoya Protocol

The rules governing access to and sharing of the benefits arising from the use of genetic resources and associated traditional knowledge (ABS) govern the relationship between providers and users of genetic resources and associated traditional knowledge.

ABS (Access to Genetic Resources and Sharing the Benefits Arising from their Utilization) regulations govern access to and use of genetic resources and associated traditional knowledge for research purposes.

ABS is a form of cooperation between States that stems from the Convention on Biological Diversity (Rio, 1992), adopted under the aegis of the United Nations, and its Additional Protocol (Nagoya, 2010).

These regulations have 3 main objectives:

  • Avoid depletion of biological resources
  • Ensure their sustainable use
  • Ensure the fair and equitable sharing of benefits (ABS) arising from the use of genetic resources.

ABS is based on the international legal principle that countries have sovereignty over their natural resources, so it is up to the "country of origin" of the Resource to :

  • Regulate, or not, access to and use of RG / CTA harvested or obtained on its territory,
  • Set any compensation for this access and use ("benefit-sharing" rules),
  • Set penalties in the event of non-compliance.
